This promotion is provided by Grantham Motor Company Limited, a company registered in England and Wales with company number 04722957 whose registered office is at Vertu House, Fifth Avenue Business Park, Team Valley, Gateshead, NE11 0XA trading as Macklin Motors Toyota (Macklin Motors Toyota). Participants agree to these terms and conditions (Terms and Conditions) and any information or guidance published by Macklin Motors Toyota form part of these Terms and Conditions.
- PROMOTION: One designated used car (Promotion Car) will be offered for sale at half the price it has previously been advertised for sale (www.macklinmotors.co.uk for at least the previous 28 days) on each day of the Macklin Motors Toyota, Ayr Racecourse Event on 2 to 5 August 2023 (Promotion Period) held at Ayr Racecourse, 2-6 Whitletts, Ayr, Ayrshire Scotland KA8 0JE (Promotion). For clarity one Promotion Car will be offered at half price on 2 August, one on 3 August, one on 4 August and one on 5 August (five Promotion Cars in total during the Promotion Period).
The Promotion Car is available for sale on a first come first served basis. The choice of Promotion Car is at Macklin Motors Toyota's absolute discretion. There is no cash alternative. The Promotion is not available in conjunction with any other offer. - ELIGIBILITY:The Promotion is open to prospective customers of Macklin Motors Toyota who (1) attend the Macklin Motors Toyota, Ayr Racecourse Event in person; (2) are resident in the UK; (3) are purchasing a vehicle for their own personal use; and (4) are over the age of 18. Employees of Macklin Motors Toyota or its affiliates, advertising or promotion agencies are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse and life partners) and commercial and trade buyers are not eligible.
Participants must:- Collect and retain the lowest numbered entry card from the Promotion Car on the particular day of the Promotion; and
- Sign (signature or SMS agreement) a complete and valid order with, and pay a full deposit to, a sales representative of Macklin Motors Toyota for the Promotion Car.
- SELECTION OF BUYER: The Promotion Car will be sold to the first Participant to sign and complete a valid order for the Promotion Vehicle. In the event that more than one participant completes a valid order and pays the deposit in full at the same time the buyer of the Promotion Vehicle will be the person with the lowest numbered entry card and any signed order for the Promotion Vehicle with any other person will be immediately cancelled and any deposit returned without liability.
- PARTICIPATION: Each Participant may only purchase one Promotion Car and must only do so on their own behalf. Participation constitutes full and unconditional acceptance of these Terms and Conditions which may be updated from time to time. Macklin Motors Toyota is not responsible for any failure or inability to purchase a Promotion Car. Macklin Motors Toyota reserves the right to disqualify any Participant who it considers (at its absolute discretion) has violated these Terms and Conditions.
- CANCELLATION: If the order for the Promotion Car is cancelled by a Participant or if a Promotion Car is not sold on the applicable day during the Promotion Period Macklin Motors Toyota may in its absolute discretion re-offer the Promotion Car for sale.
- USE OF YOUR PERSONAL DATA: Any personal data provided when purchasing a car may be used by Macklin Motors Toyota and any affiliated company and shall be processed in accordance with the Macklin Motors Toyota Privacy Notice.
- OTHER: No correspondence will be entered into regarding either this Promotion or these Terms and Conditions. In the unlikely event of a dispute, Macklin Motors Toyota's decision shall be final. Macklin Motors Toyota reserves the right to amend, modify, cancel or withdraw this Promotion at any time and for any reason, without notice. Participants in this Promotion agree that Macklin Motors Toyota will have no liability whatsoever for any injuries, costs, damage, disappointment or losses of any kind resulting in whole or in part, directly or indirectly from participation in this Promotion. Nothing in this clause shall limit Macklin Motors Toyota's liability in respect of death or personal injury arising out of its own negligence or liability arising out of Macklin Motors Toyota's fraud.
- SPIRIT OF THE PROMOTION: If a Participant attempts to compromise the integrity or the legitimate operation of this Promotion by cheating or committing fraud in ANY way, we may seek damages from that Participant to the fullest extent permitted by law. Further, we will disqualify that Participant's claim and may ban the entrant from participating in any future promotions run by Macklin Motors Toyota or any of its affiliates. Macklin Motors Toyota shall have the right, where necessary, to undertake all such action as is reasonable to protect themselves against fraudulent or invalid claims including, without limitation, to generate or require further verification as to proof of identity, age, and other relevant details of a Participant, deny selling the Promotion Car(s) or terminate the Promotion due to excessive fraud. This process may involve Macklin Motors Toyota sharing information with third parties.
- LAW AND JURISDICTION: This Promotion and these Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. The Participant irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
